Associate Corporate Counsel, Litigation

 

The Litigation Department extra-contractual and bad faith unit serves as internal counsel to AmTrust’s U.S. based, specialty, core, property and workers compensation claims organizations.  

 

 As Associate Corporate Counsel, Litigation you will provide coverage and bad faith analysis. You will also provide strategic advice on settlement opportunities and manage a national pending of extra-contractual matters.  This position provides consultation, critical analysis, and strategic development recommendations relative to the most complex and challenging claims circumstances across all AmTrust products, business lines and jurisdictions.  

Day-to-day responsibilities involve consulting with claims examiners and managers on responses to settlement demands, partnering with other litigation department units on coverage or overall claims resolution strategy, performing legal research, assisting with corporate discovery, and advising on overall claim resolution strategy. You will also manage a portfolio of national extra-contractual matters.

 

This position may be remote, or reside in any AmTrust claims office (subject to space constraints).  Occasional travel may be required.

Responsibilities

Responsibilities include:

  • Provide coverage analysis, including addressing bad faith and extra-contractual concerns;
  • Legal research and analysis, including providing conclusions and recommendations for coverage issues and claims handling decisions relative to bad faith and extra-contractual exposure;
  • Develop and analyze broad claims, underwriting and litigation data with a focus on isolating areas of concern and improvement;
  • Succinct presentation of complex issues to upper management in the Claim, Litigation and Underwriting Departments;
  • Give guidance on additional investigation that may be required to resolve coverage and extra-contractual concerns;
  • Communicate with Company stakeholders in Underwriting, Regulatory, Audit and Corporate Legal.
  • Inform concerning jurisdictional nuances;
  • Desk management of an extra-contractual pending;
  • Consulting on pending time limit and policy limit demands;
  • Collaborate with outside counsel to formulate proactive litigation and pre-suit strategies:
  • Direct and manage case strategy and budget;
  • Review, comment upon and approve pleadings and motion papers;
  • Assist with deposition preparation and custodian interviews;
  • Assist with internal investigations relative to extra-contractual and bad faith matters.
  • Assist with litigation holds and ESI collections; and
  • Communicate with upper level claims management and Litigation Department leadership.

Qualifications

Qualifications: 

  • JD American Bar Association accredited law school;
  • 4+ years liability coverage experience (in-house or law firm);
  • Understanding of national coverage and extra contractual/bad faith law;
  • Ability to track down information and navigate large company with minimal guidance;
  • Excellent oral and written communication skills, and;
  • Basic Excel skills.

The salary range for this role is $125,000.00- $150,000.00. This range is only applicable for jobs to be performed in California. Base pay offered may vary depending on, but not limited to education, experience, skills, geographic location, travel requirements, sales or revenue-based metrics. This range may be modified in the future.
